We at ACRE Capital Partners (“ACRE” or “We,” “Us,” or “Our”), have created this Privacy & Cookie Policy (”Privacy Policy”) to explain how we collect, use and share information we obtain through our website located at www.acrecp.com (the “Site”) as well as any internet services we may offer (together, the “Internet Services”). Except as described in Sections 2 and 4, this Privacy Policy does not govern our use of any information you communicate with us in any manner other than through the Internet Services, including but not limited to information you provide to us when you call us or write to us. Because the Internet is global, information about you that we collect may be transferred to, processed in, and held in countries (including the United States) other than the one in which you reside. By using this Site, you explicitly consent to such use of your information and agree to the terms of this Privacy Policy. This Privacy Policy was updated as of October 2023, and as described below, may be updated from time to time.
1. Information We Automatically Collect, Including Through Use Of Cookies

2. Our Information Sharing Practices

3. Modifying And Deleting Your Personal Data

We have controls in place designed to ensure that the information we have is relevant, accurate, and appropriate for the purposes used. If you believe that any data about you is inaccurate, please let us know by contacting info@acrecp.com. Please note that any Personal Data that we have copied may remain in back-up storage for some period of time after your request, and that if you delete certain information you may not be able to use our services in the future without re-submitting such information. Also, please note that we will maintain Personal Data in our database whenever we are required to do so by law or regulation.
​Under California Civil law, Californians are entitled to request information relating to whether a business has disclosed personal data to any third parties for the third parties’ direct marketing purposes. 4. SEC Regulations S-P, S-AM And The GRAMM-LEACH-BLILEY ACT - Privacy Notices

Some regulators such as the Securities and Exchange Commission, the U.K. Information Commissioner and the Federal Trade Commission have adopted rules that require financial institutions, like ACRE, to provide privacy policy notices to their clients. ACRE believes that protecting the privacy of current, former and prospective investors and their personal information is of the utmost importance and we are committed to maintaining the privacy of such information in our possession. In accordance with these rules, we are providing current and prospective investors with the following information:
​ACRE collects non-public personal information about current and prospective investors from the following sources: (i) information we receive from current and prospective investors on managed account agreements or subscription documents and related forms (for example, name, address, social security number, birth date, assets, income, investment experience); (ii) information about investor’s transactions with ACRE; and (iii) the Internet Services.
​We restrict access of current, former and prospective investors’ non-public personal information to our affiliates and their personnel, counsel, regulators, auditors, administrators, counterparties, and service providers who need to know that information in order to (i) ensure compliance with applicable laws and regulations, (ii) administer your account and provide products or services to ACRE and/or its investors, or (iii) as otherwise required by law. ACRE maintains physical, electronic and procedural controls in keeping with federal standards to safeguard the non-public personal information about current, former and prospective investors that is in our possession.
​Non-public personal information is not shared with third-parties for their marketing purposes.
​If, at any time in the future, it is necessary to disclose any of a client’s personal information in a way that is inconsistent with this policy, ACRE will give advance notice of the proposed change so that its clients will have the opportunity to “opt out” of such disclosure.

5. Security

We have implemented reasonable measures to help protect your User Information from loss, misuse or unauthorized access or disclosure. Unfortunately, however, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your User Information, we cannot guarantee its security.

The Site may contain links to other websites. We are not responsible for the privacy practices of any such other website (whether accessed through an advertisement, service or content link) and urge you to review such practices prior to submitting any information to such websites.
7. Changes

If under any such update we make any material change to the way in which we treat your User Information, we will inform you of such change via e-mail or by posting a notice on relevant areas of the Site. 8. International Data Transfers
